CFTC’s Bitcoin Trading Plan Still Leaves Congress A Role

The US Commodity Futures Trading Commission has opened a debate over how a federal crypto trading framework could work, including for Bitcoin. Its October 5 initiative remains an advance notice of proposed rulemaking. The distinction matters: the agency is gathering input on a possible framework, and has not completed new operating rules through this consultation.

TL;DR: The CFTC is exploring tailored crypto transaction and market rules. Its chairman says a universal requirement to use federally registered platforms would still need congressional action.

A federal route with defined limits

The Commission’s announcement describes a request for comment on margined, leveraged or financed retail crypto commodity transactions under section 2(c)(2)(D) of the Commodity Exchange Act. It also considers a purpose-built category of designated contract market called a crypto asset market. These are building blocks for potential future agency action.

In an October 5 explanation published by the CFTC, Chairman Michael S. Selig described the transaction framework as Regulation CTX and the market framework as Regulation CAM. He presented them as a way for CFTC-registered exchanges to offer relevant crypto assets within a federal structure.

Selig also set out an important jurisdictional limit. In his explanation, the initiative would not require every crypto asset to trade on a CFTC-registered platform; imposing that universal requirement would need legislation. That is the chairman’s account of the proposal’s intended reach, rather than evidence that Congress has already adopted a comprehensive market structure law.

The distinction separates two policy questions often bundled together: what conditions a federally supervised venue should meet, and which businesses must enter that system. Progress on the first does not, by itself, answer the second. For Bitcoin users, it also means a federal framework cannot be assumed to cover every service carrying the same asset.

The practical questions behind the proposed structure

The full consultation document asks how round-the-clock trading should affect market requirements. It also seeks views on using public blockchain data for reporting and ledger reconciliation, and on circumstances in which a blockchain could support matching or execution. Operational risks and backup arrangements are part of that discussion.

Those questions expose a practical challenge: a public transaction record does not itself settle every issue in operating a trading venue. A framework still needs to address how the platform performs its functions and manages disruption. The relevant comparison is therefore between specific arrangements and obligations, rather than between broad labels such as “onchain” and “traditional.”

The Commission says comments are due within 60 days of publication in the Federal Register. The October 5 press release date should not be substituted for that publication date when calculating a deadline. Feedback will inform what the agency does next; the consultation does not guarantee that every option it discusses will become a rule.

For Bitcoin trading businesses, a federal venue option would create a concrete question about which activities fit the proposed structure and what operating obligations would follow. Those choices cannot be settled from the framework’s name alone. The next substantive milestones are the agency’s response to comments and the text of any subsequent rules.
