By failing to comply with FISA&#039;s unequivocal and unobtrusive requirements, the administration has jeopardized the usefulness of any evidence obtained from the wiretaps in any later criminal prosecution.  And as far as we know, the administration cannot give any reason whatsoever for its refusal simply to ask the FISA court to validate the wiretaps after-the-fact as permitted under FISA.</description>
